The following terms and conditions set forth the terms and conditions under which individuals participate in the Old Town Warrenton Fall Festival event hosted by The Fauquier Chamber of Commerce.
Tents must be weighted/secured on all four corners. Weights are available for rent.
Food vendors are required to display a temporary food permit and a complete listing of their prices.
Due to the crowds and Health Department regulations, pets are not
allowed (working and service dogs
excluded
Should problems arise or should you
need additional information, please
call the Fauquier Chamber of
Commerce at 540-347-4414 before the event or 540-422-5716 during the event.
Remember you must provide your own tables, chairs, tents, etc. as needed.
Festival held rain or shine – no refunds for any reason
No generators will be allowed unless previously approved by the chamber of commerce staff.
Despite all the planning, we know that all things might not go as expected and we ask for your patience and understanding particularly with the volunteers as they are just that and only doing this as a show of support for the community and this event.

CANCELLATIONS & REFUNDS
1.1 The Old Town Warrenton Fall Festival is are held rain or shine. Inclement weather is unpredictable and may create delays. Event organizer reserves the right to halt or delay events if we feel the weather is creating unsafe conditions for vendors, staff and attendees.
1.2 All sales are final
1.3 Refunds
1.3.1 Refunds will be allowed if submitted in writing within 90 days in advance of the event. After 90 days, no refunds will be permitted.
1.3.2 Approved refunds include the cost of the booth/food truck space only. The credit card processing fee and the event fee will not be refunded.
1.4 Provided the nature of our business and events, we cannot and do not offer refunds under any circumstances.
1.5 Vendors may not request a credit/rain-check due to weather or other acts of Mother Nature.
1.6 Forfeiture/Transfers
1.7 In the event you cannot attend the event that you've purchased space for, then you may choose one of two options:
1.7.1 Forfeit the purchase amount
1.7.2. Sell your ticket to another individual (after the sale, you can use your original ticket confirmation link to transfer and reissue the ticket in the buyer's name)
Vendors wishing to sell their space MUST contact the event organizer in advance for approval. Sales made without prior approval will result in the vendor being unable to exhibit.
ACKNOWLEDGEMENT OF RISK AND LIABILITY RELEASE
2.1 Acknowledgement of Risk: The applicant acknowledges that participating in the Event involves inherent risks, including but not limited to the risk of physical injury, property damage, and loss of personal property
.
2.2 Liability Release: The applicant hereby releases and forever discharges the Fauquier Chamber of Commerce, its officers, employees, agents, contractors, and volunteers from any and all claims, damages, or liabilities arising from or related to the applicant’s participation in the Event, whether caused by the Fauquier Chamber of Commerce’s negligence or otherwise.
ASSUMPTION OF RISK
3.1 Assumption of Risk: The applicant assumes all risks associated with participation in the Event, including but not limited to the risk of physical injury, property damage, and loss of personal property.
3.2 Acknowledgement of Responsibility: The applicant acknowledges and agrees that he or she is solely responsible for his or her own safety and well-being during the Event, and that the Fauquier Chamber of Commerce shall not be liable for any injuries or damages that may occur as a result of the applicant participation in the Event.
INDEMNIFICATION
4.1 Indemnification: The applicant agrees to indemnify, defend, and hold harmless the Fauquier Chamber of Commerce, its officers, employees, agents, contractors, and volunteers from any and all claims, damages, or liabilities arising from or related to the applicant participation in the Event, including but not limited to any claims brought by third parties.
4.2 Scope of Indemnification: The applicant’s obligation to indemnify the Fauquier Chamber of Commerce shall include, without limitation, any damages, expenses, or attorneys’ fees incurred by the Fauquier Chamber of Commerce in connection with any claims, demands, or actions arising from or related to the applicant’s participation in the Event.
RELEASE OF LIABILITY
5.1 Release of Liability: The applicant hereby releases and forever discharges the Fauquier Chamber of Commerce, its officers, employees, agents, contractors, and volunteers from any and all claims, damages, or liabilities arising from or related to the applicant’s participation in the Event, whether caused by the Fauquier Chamber of Commerce’s negligence or otherwise.
5.2 No Third-Party Claims: The applicant acknowledges and agrees that this Agreement is intended to release the Fauquier Chamber of Commerce only from liability to the applicant, and that it does not release the Fauquier Chamber of Commerce from liability to any third party.
GOVERNING LAW
6.1 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state in which the Event is held, without giving effect to any choice or conflict of law provision or rule.
6.2 Jurisdiction and Venue: The parties hereby submit to the exclusive jurisdiction of the courts located in the state in which the Event is held for any disputes arising under or related to this Agreement.
ENTIRE AGREEMENT
7.1 Entire Agreement: This Agreement constitutes the entire agreement between the applicant and the Fauquier Chamber of Commerce with respect to the subject matter hereof, and supersedes all prior and contemporaneous agreements and understandings, whether oral or written.
7.2 Amendments: This Agreement may not be amended or modified except in writing signed by both parties.
