CODE OF CONDUCT
1- Respect the property of the convention site, attendees, media guests, exhibitors, staff members and fellow Heroes.
2 - Respect the direction and decisions of the Indiana Comic Convention Staff Supervisors, Managers and Directors.
3 - HEROES are not permitted in the green room or backstage areas.
4 - Abide by all directions given by members of security.
5 - ALWAYS be courteous and friendly to every attendee.
6 - Refrain from acts that may result in injury, fighting or horseplay on event premises.
7 - No pets (except service animals).
8 - No solicitation.
9 - No drinking or use of controlled substances while on the HERO TEAM. If you become intoxicated or under the influence of a controlled substance while on the HERO TEAM, you will be removed from our Heroes list, ejected from the convention and barred from being part of the HERO TEAM in the future.
10 - Do not make promises or guarantees to exhibitors, artists, guests, celebrities or any other interested party without the express permission of your supervisor. Do not represent yourself as a ICC staff member authorized to broker deals on the behalf of Indiana Comic Convention. Brokering unauthorized deals will result in being barred from the HERO TEAM in the future.
11 - Heroes who do not fulfill their duties or perform according to our standards will not be allowed to be a Hero in future events, and in some instances, may be dismissed or ejected from the convention without pay. This includes, but is not limited to: abandoning post without securing permission and a replacement from your department managers, violating policies, or displaying a poor attitude.
HARASSMENT POLICY
Indiana Comic Convention is dedicated to a harassment-free convention experience for everyone, regardless of gender, gender identity and expression, sexual orientation, disability, physical appearance, body size, race, age, nationality or national origin, or religion. We do not tolerate harassment. In most circumstances, those involved in such behavior will be expelled from the convention.
Harassment includes, but is not limited to: verbal comments that reinforce social structures of domination (related to gender, gender identity and expression, sexual orientation, disability, physical appearance, body size, race, age, religion); overt adult images in public spaces; deliberate intimidation; stalking; following; harassing photography or recording; sustained disruption of panels or other events; inappropriate physical contact; and unwelcome sexual attention. Those asked to stop any harassing behavior or exit the convention for such behavior are expected to comply immediately.
MEDICAL WAIVER AND INDEMNITY AGREEMENT
In the event of an accident or injury while performing my duties as a Hero for Indiana Comic Convention, I authorize Indiana Comic Convention to seek and obtain medical treatment. Furthermore, I agree to indemnify, defend and hold harmless Imaginarium, LLC from all damages, losses, claims, liabilities, charges, suits, penalties, costs and/or expenses, including, but not limited to: court costs, attorneys' fees and expenses resulting from any act, omission, or negligence, causing any and all injury to myself.
ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNIFICATION AGREEMENT
In consideration of being permitted to enter the premises (“Premises”) occupied by [Dan Farr Productions, LLC or Imaginarium, LLC] (“Promoter”) for any purpose, including without limitation any business or recreational purpose (collectively, “Activities”), I, for and on behalf of myself, any minor(s) with me, and my spouse or partner, heirs, assigns, personal representatives, next of kin, and any other person or entity having any right or interest relating hereto at law or equity or by operation of any statute, rule, or regulation (collectively, “Releasors”), hereby make the following contractual representations pursuant to this Assumption of Risk, Release of Liability, and Indemnification Agreement (“Agreement”):
1. Acknowledgement of Hazardous Activities. ENTRY ONTO THE PREMISES AND ANY AND ALL ACTIVITIES ARE POTENTIALLY HAZARDOUS and involve certain risks, including serious bodily injury, illness, infection, death, emotional distress, property damage, and other personal or property injury, harm, or damage.
2. Assumption of Risk. I KNOWINGLY AND FREELY ASSUME FULL RESPONSIBILITY FOR ALL RISKS AND LIABILITIES, KNOWN OR UNKNOWN, EVEN IF ARISING FROM OR OTHERWISE RELATING IN ANY WAY TO ANY ALLEGED NEGLIGENCE, RECKLESSNESS, OR OTHER CONDUCT OF RELEASEES (AS DEFINED BELOW) OR OTHERS, ARISING FROM OR OTHERWISE RELATING IN ANY WAY TO: (i) ENTRY ONTO THE PREMISES; AND (ii) ANY AND ALL ACTIVITIES.
3. Release from Liability; Covenant Not to Sue; Indemnity. I hereby release, waive, relinquish, discharge, and covenant not to sue and further agree to indemnify, defend, and hold harmless Promoter and its members, managers, owners, officers, officials, employees, agents, representatives, guests, licensees, invitees, contractors, exhibitors, patrons, vendors, sponsoring agencies, sponsors, advertisers, volunteers, attendees, the owners and/or lessors of the Premises, and any other person or entity on the Premises or otherwise associated in any way with any of the foregoing (collectively, “Releasees”) from any liability, claims, demands, actions, causes of action, loss, cost, or expense (including without limitation attorneys’ fees and other costs) relating in any way to any and all disability, illness, infection, death, or other loss, injury, harm, or damage to any person or property arising from or otherwise relating in any way to entry onto the Premises and/or to the Activities, whether arising or resulting from or otherwise relating in any way to any alleged negligence, recklessness, or other conduct of Releasees or others, to the fullest extent
permitted by law.
4. Severability; Governing Law; Venue. I agree that this Agreement is intended to be as broad and inclusive as is permitted by the law of the State of Utah and that, if any portion hereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect. All claims or disputes arising hereunder or otherwise between any parties hereto shall first be addressed through confidential mediation with a mediator jointly selected by the parties in dispute and then, if such claim or dispute has not been resolved after a good-faith attempt at mediation, shall be subject to the mandatory and exclusive jurisdiction and venue of the state or federal courts in Salt Lake County, Utah, and each party hereto irrevocably consents to the personal jurisdiction and mandatory venue of such courts. If any party violates this provision, the non-violating party shall be entitled to: (i) anti-suit injunctive relief in the state and federal courts in Salt Lake County, Utah, enjoining the improper proceeding; (ii) dismissal in the improper proceeding; and (iii) an award of all costs and expenses (including attorneys’ fees) associated in any way with the violation.
I HEREBY REPRESENT AND WARRANT THAT I HAVE READ THIS AGREEMENT AND (i) FULLY UNDERSTAND ITS TERMS, (ii) UNDERSTAND BY SIGNING I GIVE UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE, (iii) SIGN FREELY AND VOLUNTARILY, (iv) HAVE FULL LEGAL AUTHORITY TO ENTER INTO THIS AGREEMENT, AND (v) INTEND TO COMPLETELY AND UNCONDITIONALLY RELEASE PROMOTER AND RELEASEES FROM ANY AND ALL LIABILITY ASSOCIATED IN ANY WAY WITH MY ENTRY ONTO THE PREMISES AND ANY AND ALL ACTIVITIES. I FURTHER REPRESENT THAT I HAVE READ, UNDERSTAND, AND AGREE TO THE ANTI-HARASSMENT, DRESS CODE, AND WEAPONS POLICIES FOUND IN THE HERO HANDBOOK. I UNDERSTAND AND AGREE THAT, IN
PROMOTER’S SOLE DISCRETION, PROMOTER MAY REMOVE ME FROM THE PREMISES FOR ANY OR NO REASON.
