By submitting this application you agree to the release and waiver of liability in favor of The City of Southport, and its directors, officers, employees, and agents.
The Volunteer desires to work as a volunteer for the City of Southport Community Relations Department's Springfest and engage in the activities related to being a volunteer for the City of Southport Community Relations Department (the "Activities"). The Volunteer hereby freely, voluntarily, and without duress executes this Release under the following terms:
1. Release and Waiver.
Volunteer does hereby release and forever discharge and hold harmless The City of Southport and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, that arise or may hereafter arise from Volunteer's Activities with The City of Southport.
2. Rules and Operations.
Promotion Restriction: You shall refrain from promoting the sales or generating traffic for your personal business during the course of your volunteer service.
Non-Profit Commitment: You acknowledge that volunteering is a non-profit endeavor, and you shall not seek to derive any form of financial gain or compensation from your volunteer activities.
Canine Access Policy: Dogs are strictly prohibited from entering the Festival area unless they are certified service animals, due to allergy considerations.
Notice of Unavailability: In the event that you are unable to fulfill your scheduled volunteer commitment, it is imperative that you provide a minimum of 48 hours' notice. Failure to do so may result in an inability to guarantee a replacement for your absence.
Disciplinary Procedures: The Volunteer acknowledges that their participation in the Activities is contingent upon adherence to The City of Southport’s policies, guidelines, and standards of behavior. In the event of any violation of the rules, conduct, or operational policies, the following progressive disciplinary steps may be followed:
Verbal Warning: The Volunteer will receive a verbal warning from a supervisor, explaining the issue and providing guidance on expected behavior.
Written Warning: If the issue persists or is deemed more serious, the Volunteer will receive a written warning outlining the specific concerns, required actions, and a timeline for improvement.
Written Write-up: If the behavior continues after a written warning, the Volunteer will receive a formal written write-up, which may include an explanation of further consequences and a final opportunity to correct the issue.
Dismissal: Continued non-compliance, misconduct, or failure to improve may lead to dismissal from the volunteer program at the discretion of The City of Southport. The Volunteer may be removed from their role immediately, with or without prior notice, depending on the severity of the issue.
The City of Southport reserves the right to modify or skip these steps in cases of severe violations, including but not limited to illegal activity, harassment, or actions that pose a risk to others.
3. Medical Treatment.
Volunteer does hereby release and forever discharge The City of Southport from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Volunteer's Activities with The City of Southport.
4. Assumption of the Risk.
Volunteer hereby expressly and specifically assumes the risk of injury or harm in the Activities and releases The City of Southport from all liability for injury, illness, death, or property damage resulting from the Activities.
5. Insurance.
The Volunteer understands that, except as otherwise agreed to by The City of Southport in writing, The City of Southport does not carry or maintain health, medical, or disability insurance coverage for any Volunteer. Each Volunteer is expected and encouraged to obtain his or her own medical or health insurance coverage.
6. Photographic Release.
Volunteer does hereby grant and convey unto The City of Southport all right, title, and interest in any and all photographic images and video or audio recordings made by The City of Southport during the Volunteer's Activities with The City of Southport, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
7. Other.
Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of North Carolina, and that this Release shall be governed by and interpreted in accordance with the laws of the State of North Carolina. Volunteer also agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect remaining provisions of this Release which shall continue to be enforceable.
Volunteer has executed this Release as of the date of submission of this application.
