As a Food & Beverage vendor, I agree:
1. The booth I rent shall be used exclusively for the sale of the submitted and agreed-upon menu.
2. To remain in compliance with applicable federal, state and local laws, ordinances and regulations, I will always comply with health and safety requirements and obtain necessary licensing, permits and insurance for the sale of food and beverages at the food booth.
3. I shall maintain the booth and the area surrounding the booth in conformity with all applicable sanitary and health laws and regulations and shall also keep the booth and the surrounding area neat, clean, and free of accumulated refuse and debris. I will place a tarp or something similar on the ground in my booth to keep the pavement clean. No grease shall be disposed of at the event. I will dump nothing into the sewer.
4. Amplified sound is not permitted to come from my booth.
5. To consent to the assignment of my booth space by the festival organizers, the organizer reserves the right to reassign booth locations at any time prior to the beginning of the festival.
6. Booth rental fees are due and payable by August 29th, 2025. Failure to pay the fee may result in loss of my space at Hot Diggity Dog Fest. Rental fees are non-refundable.
7. I will not assign any rights under this agreement to any person.
8. My relationship with the organization under this agreement shall be that of an independent contractor. I shall not have the authority to bind the organization to any contract or agreement, nor shall I represent to any person that I am the agent or representative of the organization.
9. Neither I nor the organization shall be liable to the other for any delay or failure to perform due to government action, court order, civil disturbance, inclement weather, act of God, or other cause beyond the reasonable control of the party whose performance is delayed or prevented.
10. Except as otherwise specified in this agreement, neither party shall be liable to the other party for consequential damages, including lost profit or no revenue, for any breach of the agreement.
11. To indemnify and hold harmless from all claims Boyle Investment Company, Boyle Nashville, LLC, Capitol View JV-E, and Capitol View JV-D.
12. For onsite cooking- All food vendors shall use hot boxes, sterno burners, or electric cooking equipment. No open gas or propane flames and no deep frying or oil vats unless PRIOR WRITTEN OWNER and PROPERTY MANAGEMENT APPROVAL and subject to certain rules and restrictions.
13. No coolers or “bring your own drinks” shall be permitted. Any alcohol available for the event shall be provided by licensed vendors which shall require age verification and shall comply any other requirements by applicable law. Any guest attending the event shall be required to be ID’d before the sale of alcohol. The alcohol vendor shall provide wristbands or other indications of the proper drinking age. No alcohol shall be permitted to leave the Event Area. In the event of any severe weather conditions, the scheduled Hot Diggity Dog Fest may be suspended. The decision to postpone the event is left solely up to the discretion of the Directors of Hot Diggity Dog Fest. In the event of inclement weather, we may try to reschedule to September 7th, 2025. If severe weather continues into September 7th, 2025 the Hot Diggity Dog Fest will be canceled. No refunds will be provided due to issues beyond the festival’s control, such as weather. The following is needed when accepted to participate in our event:
- A check to cover your booth fee. This will be invoiced to you separately.
- A copy of your insurance certificate listing a single limit liability of not less than $_1_ million, and general aggregate liability of not less than $_2_ million. Auto liability with a combined single limit not less than $ _1_million, and Umbrella/Excess Liability of not less than $_3_million. Capitol View JV-E, Capitol View JV-D, Boyle Investment Company, and Boyle Nashville, LLC shall be named as an additional insured of said policy. Certificate Holder will be Capitol View JV-E, 500 11th Ave N, Suite 780, Nashville TN 37203
- A correct COI and a signed Waiver must be submitted no later than August 30th to secure your space.
