ACCEPTED VENDORS
Licensed Cart Vendors only – limited spaces available. All applicants selling food items must comply with the Health Department and send us a copy of their permit. The Cobb County Health Department will be inspecting all food vendors on the first morning of the event. Once accepted, the Cobb Public Health Department link will be sent to you for details. Food vendors will also have to have a current Marietta Fire permit. A link to the permit will be sent once your application is approved.
FEES
The 2025 Cart Vendor price is $400 for one (1) cart, and $800 for two (2) carts.The fee includes a designated space in the festival on October 11-12, 2025. Additionally, your logo will be listed on the Chalktoberfest website. We will not charge a percentage of your sales.
AREA
Cart Vendors will be designated a location in the festival. Vendors are not permitted to move. There is no access to power.
PARKING
Parking will be available in the City of Marietta parking deck located one block off the Marietta Square. No cars will be permitted in the Festival area except during set-up and tear-down times.
SECURITY
Security will be provided by MCMA and the City of Marietta throughout the event and after hours. However, please be aware that MCMA Chalktoberfest 2025, the City of Marietta, the Marietta/Cobb Museum of Art and its staff are not to be held liable for any lost, stolen or damaged items.
TAXES
Each vendor is solely responsible for collecting, reporting and submitting sales tax payment to the Georgia Department of Revenue, Sales and Use Tax Division. Cobb County tax is 6%.

FORCE MAJEURE
"Event of Force Majeure" means an event beyond the control of the MCMA or the vendor, which prevents either party from complying with any of its obligations under this contract, including but not limited to: acts of God (such as, but not limited to, fires, explosions, earthquakes, drought, tidal waves and floods); war, hostilities (whether war be declared or not), invasion, act of foreign enemies, mobilization, requisition, or embargo; rebellion, revolution, insurrection, or military or usurped power, or civil war; contamination by radio-activity from any nuclear fuel, or from any nuclear waste from the combustion of nuclear fuel, radio-active toxic explosive, or other hazardous properties of any explosive nuclear assembly or nuclear component of such assembly; riot, commotion, strikes, go-slows, lock outs or disorder; an outbreak, epidemic, pandemic, or any other widespread public health crisis; or acts or threats of terrorism.
Neither the MCMA nor the vendor shall be considered in breach of this contract to the extent that the performance of their respective obligations is prevented by an Event of Force Majeure that arises.
For the purposes of this contract, both MCMA and the vendor agree that neither party will be held responsible for breaching this contract if obligations cannot be met due to the COVID-19 pandemic or any other widespread health crisis requiring government shelter-in-place orders, states of emergency, etc.
ACKNOWLEDGMENT OF TERMS
By submitting my application via Eventeny.com, I hereby make my application to participate in the 2025 MCMA Chalktoberfest event at the Marietta Square. I have read, understood, and agree to abide by the rules and regulations set forth and other rules as may be established and presented at my acceptance. I release and forever discharge the 2025 MCMA Chalktoberfest, the City of Marietta, Marietta Cobb Museum of Art, its staff, and volunteers, from any responsibility, personal liability, loss, claims, or damages arising out of, or in conjunction with the 2025 MCMA Chalktoberfest event.
