1.Vendors may use facilities at the Lincoln County Fairgrounds for the purposes of selling food and beverages, providing merchandise for sale to the public, advertising to the public, or other exhibiting on the following dates: August 1 – August 9, 2025. Vendor hereby acknowledges that Vendor is not permitted to serve food or drink that would require an open flame, hot grease, or other potentially dangerous or threatening materials or circumstances.
2. Fair will provide only the facilities necessary (electricity) to facilitate the operation of General Vendor’s equipment required at the Lincoln County Fairgrounds. The Vendor will provide all equipment and labor necessary for its operations.
3. If Vendor is selling food or drink, Vendor will utilize safe food handling practices as directed by the Lincoln County Fair Board as set forth by the State of Wyoming Food Safety Rules at all times while in operation at the Lincoln County Fairgrounds.
4. The Fair will assign Vendor a location to which they shall sell their permitted items for the duration of the Fair. Vendors are required to clean the assigned area at the end of the specified operating period. Failure to do so may result in additional fees being assessed and forfeiture of future operating privileges.
5. Payment of registration fees is required at time of registration. Failure to provide payment will result in forfeiture of reservation of vending space.
6. Vendor is entitled to all revenues and receipts obtained from the sale of food and beverage at the Lincoln County Fairgrounds.
7. All Vendors who transact business must comply with Wyoming Department of Revenue requirements.
8. Vendor has a Wyoming State Sales Tax Number: __________________________; or
8a. Vendor is a Temporary Business Operator and will attach a Temporary Business Operations Application to this Agreement.
9. Vendor trailers, equipment and structures are expected to be maintained in a clean and orderly fashion so as to present a professional appearance. Consideration should be given to appropriate signage, displays, and artwork.
10. A general list of intended items to be offered for sale during the event or an explanation of the intended use of the booth is required to be submitted at time of application. An effort to provide a variety of vendor items for sale will be made and priority given on a “first come, first served” basis. Preference will also be considered for established vendors returning year after year provided they are in good standing. The Lincoln County Fair will review and approve/deny your menu or proposed offerings no later than July 15, 2025.
11. The Lincoln County Fair will enforce a strict adherence to the space assigned and ensure that all the front of all booths/tents are in line with all other Vendors. Vendors in between metal buildings will not extend out past the front of the metal buildings, nor will Vendors in Metal Buildings be allowed to extend out in front of the metal building. 12. If Vendor intends to transact business, Vendor shall provide proof of Afton Town Business License. This payment is paid directly to the Town of Afton. Receipt of completion shall be attached to this Agreement.
13. Vendor will indemnify, defend and hold harmless Lincoln County and the Lincoln County Fair Board from and against all claims, demands, causes of action, losses, damages, fines, penalties, liabilities, costs and expenses, including attorney’s fees sustained and incurred by or asserted against Lincoln County and the Lincoln County Fair Board arising out of Vendor’s use of the Lincoln County Fairgrounds facilities and vendor purposes at the Lincoln County Fairgrounds. 14. Lincoln County does not waive its sovereign immunity by entering into this agreement and specifically retains immunity and all other defenses available to it as a sovereign pursuant to W.S. § 1-39-104(a) and all other state laws.
