RULES & REGULATIONS
ACCEPTANCE: The applicant acknowledges decisions with request to applications, will be necessarily subjective and applicant specifically waives, releases, and hold harmless, The Finders Keepers Vintage Market (FKVM), from any actions, or damages arising out of an application denial.
SALE OR PURCHASE: FKVM is not in any way responsible for the sale or purchase of items. FKVM is not responsible to enforce the terms of any sales transactions between the vendors and vendees who participate in the FKVM.
CANCELLATION: Refunds will be given/considered at the sole discretion of FKVM.
RIGHT TO PROHIBIT: The Event Establishment (EE) and FKVM prohibits alcoholic beverages at the event unless provided by the venue or organizer, and reserves the right to prohibit any item in its sole and exclusive discretion deems necessary to protect the general health, safety, reputation and welfare of the public including firearms, stun guns or any other weapons, or any other material deemed offensive to local community standards, laws and ordinances.
INDEMNIFICATION AND RELEASE: ALL VENDORS participating in the FKVM do so at their own risk. This risk includes that associated with wind, rain, hail, lightning, floods or other acts of God. Damage to property, illness or injury, theft, acts of vandals, patrons, fellow participants, or Organizer are all at the vendors own risk. The EE nor FKVM shall not be liable for any damage to or loss of property or injury to persons arising out of or related in any way to vendor participation in the FKVM. As a condition and in consideration for Event Establishment allowing Vendor to participate in the FKVM, Vendor shall sign the Indemnification, Waiver and Release Agreement attached to this Application and Agreement as Exhibit A.
INSURANCE: NO INSURANCE IS PROVIDED TO VENDORS BY EE OR FKVM. Vendors are assuming liability and are advised to obtain appropriate liability insurance to suit their needs.
BOOTH MAINTENANCE: You must keep the area clean around your booth. There will be a minimum charge of $150.00 if the FKVM has to clean up in or around your space. It is your responsibility to secure all trip hazards (i.e. electrical cords, hoses, ropes, etc.). All property placed at the FKVM is placed at the Vendor’s own risk, and FKVM shall not be responsible for security, set-up, take-down, or any other similar matter associated with Vendor activity.
CHECK-IN/PARKING/ TEAR DOWN: Check in no later than 8:30 a.m. You will be TURNED AWAY if you arrive later than 8:30 a.m. without giving us prior notice that you will be late. Parking will be in a designated area for vendors. Market hours are from 10:00 a.m. to 4:00 p.m. Tear down and early packup is not allowed until 4pm. All tear down must be completed and property removed no later than 7:00 p.m.
GENERAL RULES: No animals (other than service dogs and other assistance animals as classified by the Americans with Disabilities Act) shall be allowed in the FKVM area. No bottles, cans, bicycles, roller blades, scooters or skateboards allowed in the market area. No alcoholic beverages or controlled substances of any kind.
RESTROOMS/SANITATION: Public restroom facilities are available. Public garbage receptacles are available. Vendors are responsible for making sure their refuse is properly deposited in an appropriate receptacle.
SECURITY: No separate security is provided. Vendors should not leave property unattended. Unattended property or suspicious activity should be reported to a Finders Keepers Vintage Market staff person.
USE OF SPACE: You are allowed to SELL ONLY FROM YOUR BOOTH. Walking up and down the aisles selling goods or distributing literature is strictly prohibited. Amplifying devices are limited to official use only. Booth assignments and location are at the sole discretion of the FKVM Organizer.
I acknowledge and understand, for myself and for my agents, representatives, heirs and assigns that, as a condition of being allowed by the Event Establishment (EE) and Finders Keepers Vintage Market (FKVM) as a vendor participant in the privately operated event, the activities in which I may participate, may expose me to serious risks of (1) injury to my person or my property, or (2) liability for injury to other persons or other property arising wholly or partially from my vendor activity. With full knowledge of those risks, I request that I be permitted to participate in the FKVM as listed /dated on the application. I further agree that I have carefully read and understand the attached Vendor Application and Agreement and agree to comply with all its terms. I further agree that I fully intend that the FKVM have the benefits of the attached Agreement and this Exhibit A as a condition of my participation as a Vendor.
In consideration for approving my application to participate as a Vendor at the FKVM, and in consideration for the EE issuing a Permit to Organizer to authorize the special event, I, for myself and for my agents, representatives, heirs and assigns, do hereby agree, to the fullest extent allowed by law, to defend, indemnify and hold harmless, and further hereby do demise, release and forever discharge both the FKVM and the EE, including its officials, officers, employees, agents, representatives and successors from and against any and all liabilities, losses, personal injury claims, wrongful death claims, property damage claims, suits, judgments, damages, costs, expenses, legal fees, and controversies of any kind at law and in equity, which may be asserted against the EE, which arise out of, or in any way are associated, directly or indirectly to my participation in or presence at the FKVM. The foregoing shall waive all causes of action, damages, claims and demands and forever discharge both FKVM and EE, including its officials, officers, employees, agents, representatives and successors from any and all claims, demands, liabilities, and controversies including costs and/or attorney fees, which may arise out of and/or are associated in anyway, directly or indirectly to the undersigned’s participation in or presence at the FKVM, whether involving injury to my person or property, or to the person or property of any third party.
