1. Terminology Clarification
In this agreement, the term "Occasion" refers to the
upcoming event known as CollectedCon, scheduled for July 13th and 14th, 2025 ("Event Dates") at the Navy Pier
("Exhibit Facility"). The ownership, production, and
management of the Event rest with CollectedCon.
Throughout this document, the term "Coordinator"
collectively refers to CollectedCon and its respective
officers, directors, agents, affiliates, representatives,
employees, and assigns, as the context dictates. The term
"Participant" collectively encompasses the entity or
individual applying for exhibit space rental, agreeing to the
terms herein upon CollectedCon’s acceptance.
2. Acceptance of Agreement
This agreement becomes legally binding once it is signed
by the Participant on the following page and countersigned
by an authorized representative of COLLECTEDCON.
3. Space Allocation
CollectedCon will assign exhibit space for the Event Dates,
reserving the right to modify the floor plan at its discretion.
4. Eligibility Criteria
CollectedCon retains the right to determine the eligibility of
prospective exhibitors, allowing participation only to those
offering products or services related to urban art, urban
clothing, vinyl toys, or other popular culture items. Display
of adult materials requires prior written permission.
5. Occupancy Regulations
Exhibitors must adhere to specified hours; failure to comply
allows CollectedCon to reclaim the space without a refund.
6. Acknowledgment of Risks; Release of Liability
TheParticipant assumes all risks associated with their
involvement in the Event, releasing CollectedCon, the
Exhibit Facility, and related parties from any claims, actions,
demands, or liabilities arising from such participation.
7. Cancellation Protocol by Participant
Partial cancellation necessitates written consent from
CollectedCon. A 50% cancellation fee applies if canceled 15
days before the Event.
8. Cancellation by CollectedCon
CollectedCon may terminate the contract for non-payment
or breach, with no refund for exhibits deemed
objectionable.
9. Event Cancellation
In unforeseen circumstances leading to Event cancellation,
the Participant receives a refund minus incurred costs, and
CollectedCon may alter Event details under specific
conditions.
10. Indemnification Obligation
The Participant agrees to indemnify, defend, and hold
CollectedCon and the Exhibit Facility harmless from any
claims, liabilities, and damages resulting from their
participation, including breaches of this agreement.
11.Liability Limitation
Under no circumstances shall CollectedCon or the Exhibit
Facility be held liable for lost profits or any incidental,
special, indirect, punitive, or consequential damages, with
CollectedCon's maximum liability not exceeding the
amount paid by the Participant for exhibit space rental.
12. Promotional Use of Information
CollectedCon is granted a license to use the Participant's
name and product names for promotional purposes,
including Event photographs.
13. Facility Maintenance Responsibility
The Participant is liable for damages caused to the Exhibit
Facility or associated property.
14. Taxation and Licensing Obligations
The Participant must obtain necessary licenses and pay
applicable taxes for activities at the Event.
15. Copyright Compliance
Exhibitors must have rights and pay royalties for any
copyrighted material displayed.
16. Legal Compliance
Participants must comply with all laws, codes, ordinances,
and regulations, including the Americans with Disabilities
Act.
17. Additional Conditions
CollectedCon maintains control over attendance policies;
all payments are non-refundable, and Exhibitors must
adhere to decorum standards. Amendments require
written consent from CollectedCon.
18. Incorporation of Rules
Uncovered matters fall under CollectedCon's
determination, and additional rules or regulations
adopted by CollectedCon are incorporated into this
agreement.
19. Applicable Law
This contract is governed by the laws of the State of
Illinois, with dispute resolution in the courts of Illinois,
specifically Chicago.
20. Display Standards: Aisle & Common Area Usage
Exhibitors must tastefully display products within their
booths, and control of aisles and common areas is vested
in CollectedCon. Unauthorized signs or exhibits in these
spaces are prohibited.
21. Sound Policies
Use of sound devices is permitted within exhibit booths
but must be controlled to avoid interference with others.
22. Fire and Safety Adherence
Exhibitors must strictly adhere to federal, state, and city
fire and safety laws.
23. Offset Rights; Enforcement
CollectedCon has the right to apply refunds to the
Participant's debts. The prevailing party in legal actions is
entitled to reimbursement of costs and legal fees.
24. AI Art
AI generated art will not be shown in any capacity, prints,
NFT, Toys etc.
25. Funko
Funko products will be approved on a case-by-case basis.
You must have written approval by CollectedCon to
display Funko products.
