Each food vendor and/or vendors using open flame and/or electricity must have on-site an appropriate certified fire extinguisher which the Fire Marshall or Fire Department must inspect, if not approved the vendor must obtain a new one, which will be inspected.
In addition each food vendor is expected to meet the State of Florida Food Handling Standards as per: www.myfloridalicense.com/dbpr/hr
FAILURE TO ABIDE BY THE FOLLOWING RULES AND REGULATIONS MAY RESULT IN REMOVAL OF ANY EXHIBIT, SHOW OR CONCESSION FROM THE FESTIVAL GROUNDS, AND/OR RESULT IN DENIAL OF FUTURE SPACE.
Swamp Cabbage Festival and its logo(s) are registered trademarks and can only be sold by the Swamp Cabbage Festival or its designee(s).
Vendor(s) agrees by accepting a vending space not to sell any items with our trademark(s) “Swamp Cabbage Festival”. Referred to as "SCF" throughout this document.
VENDOR:
Full payment for booths must be received with application. Payment will not constitute acceptance as a vendor, your payment will not be collected until final approval of application. You can check your application status by logging into your online eventeny account. If you have not heard from the festival committee about your application please contact us.
SCF uses a third party platform to process applications and payments, called eventeny. Vendors are required to complete their application using this online platform. An account with eventeny is needed to submit an application to SCF. Some fees and restrictions may apply.
Cooperation:
LaBelle is known for its friendliness. Swamp Cabbage Festival began as a hometown festival that grew to host extended family and visitors from all over. We appreciate and expect the same spirit of cooperation in return. Any vendor that does not cooperate or follow our rules will have to leave and will not be accepted back to future festivals. In accepting a vending space, you are agreeing to obey the rules or vacate when asked to do so without refund.
Limitations on products sold. Accepting a vending space allows you a permit to sale specific items, food or drink. To maintain a quality well rounded festival we reserve the right to limit, restrict or forbid the sale of items.
Food and Beverage Items may be exclusively licensed to a vendor on an annual/invitational basis. We encourage vendors to serve swamp cabbage (hearts of palm) and to be creative with its food product offerings.
This is a wholesome family event, any novelty item(s) (i.e. pictures, posters, magnets, t-shirts) or children’s toys that have projectiles, etc. that the Committee’s authorized agent considers a nuisance, vulgar or simply not “G” rated (age appropriate) will NOT be sold.
Check-in, Set up and park hours (Barron Park):
Booth set-up will be on Friday Feb 21, 2025 beginning at 8:00 am to 10:00 pm. All vendors are expected to arrive the day before the event to check-in and set up in your assigned spot. There will be no Saturday check ins.
Vendors restocking their booth, all vehicles must leave the park by 9:00am each day of the event.
A set up schedule will be sent out with times based on booth locations.
Park hours are: 9:00 am to 5:00 pm Saturday and 9:30 am to 4:00 pm on Sunday, If you close your booth early, you may not bring a vehicle in the park until after the park closes. Note: Park hours may extend until Entertainment has concluded and crowds disbursed or law enforcement has deemed safe for vehicles.
The Festival Committee determines VENDOR location, any VENDOR not satisfied with location may leave with no refund, belligerent behavior is not tolerated. Vendors must bring hand truck and sandbags to set up tents, if needed. Not all locations are accessible by vehicle, there are areas where you cannot use stakes.
NOTE: SCF or Licensor is the Swamp Cabbage Festival, Inc and Vendor or Licensee is the applicant:
1. VENDOR(S) shall comply with all laws and pertinent rules of the state of Florida, all pertinent ordinances of the County of Hendry and the City of LaBelle, as well as the Rules and Regulations governing the Swamp Cabbage Festival, Inc. Such laws, ordinances, rules and regulations are expressly made a part of this agreement.
2. BOOTHS, EXHIBITS AND CONCESSIONS MUST BE IN PLACE AND READY TO GO NO LATER THAN 09:00AM EACH DAY.
3. All fees must be paid on the date(s) incurred.
4. Any monies paid, minus a $50.00 admin/processing fee/per separate transaction, will be returned if VENDOR officially cancels by January 01, 2025.**
Swamp Cabbage Festival, Inc. does not offer a "roll over" account on any monies or a credit system towards future events on monies paid.
If the Festival is cancelled due to exigencies of war or local, state or national concerns regarding public health or safety a refund will be issued for any monies paid minus a $50.00 admin/processing fee.
**In case of acts of God, emergencies, or severe weather conditions necessitating the cancelling the Swamp Cabbage Festival in advance of or during the festival, the SCF may revoke this license, no refunds shall be given, and the SCF shall not be held liable for any of Licensee/Vendor’s losses, if any.
5. SCF reserves the right to remove from the Park and adjacent areas any exhibit, show or concession, or any part thereof which SCF deems objectionable and no refund of monies paid will be made. It is agreed if such action is taken, VENDOR waives all claims of whatsoever nature against the SCF, its Officers, Employees or Agents
6. Any authorized representative of SCF shall have access to said premises at all times.
7. A limited amount of electrical hook ups are available for an additional fee. Vendors that do not pay for the electric hookup must provide their own power needs. A quiet, low emission generator is permitted.
8. SCF RESERVES THE RIGHT TO REMOVE, OR DEMAND REMOVAL, OF ANY ITEM(S) NOT APPROVED AND LISTED ON CONTRACT/ Vendor Application.
9. Alcoholic beverages are not permitted to be sold by vendors at the festival or in public areas. The city of LaBelle ordinance prohibits open carry of alcoholic beverages without special permission and license.
10. Animals, reptiles, etc. are not permitted in the Park on leash or otherwise. The only exception being police dogs on duty, service animals with certificates, and animals in scheduled acts, shows or contests. Animals in scheduled acts, shows or contests must be housed humanely immediately following their performance.
MOVING VEHICLES (including golf carts and gators-utility vehicles) OF ANY TYPE ARE NOT ALLOWED ON THE PARK DURING OPERATING HOURS, Except by Emergency Services (Police, fire, EMS), Swamp Cabbage Officials and its designees, specifically SCF’s official ice vendor during deliveries.
11. VENDOR may not engage in activities or demonstrations outside their contracted space. Solicitors, vendors and/or sales people will not be allowed to work in the aisles, free-roam in the park or the roadways.
All material(s) and vending must remain inside the contracted space.
12. VENDOR may advertise and/or display from within Licensee/Vendor's contracted space only. Signs used by VENDOR must relate to Licensee/Vendor's name, product(s) or service(s) normally offered by Licensee/Vendor.
VENDOR SHALL NOT EMPLOY OR DISPLAY SIGNS ADVERTISING OR PROMOTING OTHER VENDORS OR SUPPLIERS unless authorized by SCF.
13. This is a Family Event, think “G” rated. NO “adult themed” or promiscuous shirts, or literature is permitted, handing out any type of “adult themed” literature is not permitted, even from within licensed space. Violators will be closed during the Festival, removed from grounds after hours and no refund will be due to the Vendor.
14. The VENDOR agrees as an express condition of this agreement that the VENDOR shall not attempt to acquire a mailing list of Festival patrons by any method or scheme until and unless the VENDOR has received written permission of the SCF.
15. NO DRAWING OR GIVEAWAY MAY BE CONDUCTED BY VENDOR UNLESS PERMISSION HAS BEEN GRANTED BY SCF. A list of names and the prize(s) won, must be delivered to the Festival Office at the time of the drawing or giveaway.
THESE FORMS MAY NOT BE SOLD, BARTERED, OR TRADED IN ANY MANNER. THEY MUST BE DESTROYED BY SHREDDING.
16. VENDOR will furnish SCF a valid Certificate of Liability and Product Insurance coverage by a company authorized to do business in the State of Florida, in the amount of one million dollars per occurrence.
This certificate of insurance must name CITY OF LABELLE/SCF as additional insured. This certificate must be in the possession of SCF before VENDOR will be allowed to operate on these premises.

17. VENDOR agrees to post prices of products being sold in a conspicuous and easy to see location within their booth or concession.
18. NO VOICE OR SOUND AMPLIFICATION SHALL BE USED BY VENDOR without prior consent of SCF. Such permission, if granted, may be rescinded at any time by SCF.
19. All decorations, paints or products used by VENDOR to decorate booths MUST BE FLAMEPROOF and subject to testing by the LaBelle Fire Marshall before approval. Any item causing a potential fire hazard must be removed or shut down.
20. All food booths and concessions are required to have certified fire extinguishers. The Fire Marshall and/or members of the LaBelle Fire Department will inspect each one before the Festival opens. The Fire Marshall/Chief or designees may require vendor(s) to relocate, remove or cease use of any items, equipment, cooking equipment they consider a potential fire or health hazard.
21. Food Concession operators are required to deposit grease in marked containers placed on the Festival grounds for that purpose. GRAY WATER MUST BE DEPOSED IN APPROPRIATE CONTAINERS ON FESTIVAL GROUNDS. Grease must not be put into the garbage cans placed beside the concessions.
ANY CONCESSIONAIRE WHO DEPOSITS GREASE IN THE STORM DRAINS, ON THE GROUND, IN THE GARBAGE CANS, OR ANY PLACE OTHER THAN THAT APPROVED, WILL BE FINED AND REMOVED FROM THE FESTIVAL GROUNDS. ALL MONIES FORFEITED.
22. VENDOR is required to keep contracted space free of trash, paper or refuse. VENDOR must take trash, paper or refuse to the nearest container, and not put into the walkway, or left in the contracted space. It is the responsibility of VENDOR to have their space clean by 7:00 p.m. each evening.
23. Swamp Cabbage Festival has an ice vendor onsite as a service to vendors. Vendors may bring their own ice.
24. ANYTHING CONSTRUCTED OR INSTALLED BY VENDOR MUST BE REMOVED BY END OF FESTIVAL.
25. SIGNS, DECORATIONS, MERCHANDISE OR OTHER ITEMS MUST NOT BE PLACED OUTSIDE THE RENTED SPACE unless granted by SCF.
26. VENDOR may not block view of or impede flow to adjacent booths.
27. ALL MATERIAL AND EQUIPMENT BELONGING TO VENDOR MUST BE REMOVED FROM THE FESTIVAL GROUNDS before midnight on Sunday. SCF will not assume responsibility for storing any material or equipment. Items not removed will be considered abandoned and become the property of SCF, who shall dispose of them in any manner deemed necessary. Cost of disposal will be billed to the VENDOR. IF BILL REMAINS UNPAID, those VENDORs shall have their next year’s payment, if any, forfeited and may not be allowed to return.
28. There will be general security in the park on Friday and Saturday evening. No security is provided after the festival ends on Sunday at 4:00 pm. However, all property taken into the Festival grounds by VENDOR is taken there at the VENDOR’s own risk. SCF shall not be responsible for any loss due to damage from fire, theft, windstorm, repossession, or from any other cause whatsoever, nor for failure upon its part to perform this agreement, should Officers of the law seize, stop or prevent VENDOR from operating under this license, the VENDOR will close its space and remove all items after festival hours. No refunds.
29. VENDOR will receive two (2) vendor parking passes for each Licensee/Vendor. Other parking is provided by third party vendors and is available at cost to the vendor. There are no RV hookups, self contained units may use one of the parking passes provided, as space allows. Space is limited, your vehicle may be blocked, any vendor that needs to come and go from the parking area should consider the paid parking areas. Parking is not available Sunday night. This is a courtesy, provided by the SCF. The SCF assumes no liability for any damage or theft for any reason. Park at your own risk.
30. Food vendors will be charged a water hook up, waste water and trash disposal fee. Vendors must bring a water hose and a splitter or their own potable water.
31. VENDOR AGREES NOT TO SUB-LEASE ANY PART OF SPACE HEREIN STATED, OR TO EXHIBIT ANY MERCHANDISE OR SERVICE, OTHER THAN THAT OWNED BY LICENSEE/VENDOR, AND SPECIFIED IN THE LICENSE AGREEMENT. VIOLATION MAY RESULT IN REMOVAL OF UNAUTHORIZED ITEMS, CANCELLATION OF LICENSE, OR BOTH, AND RESULT IN DENIAL OF FUTURE LICENSE CONSIDERATION unless permitted by Festival Committee and stated in the vendor application.
32. Unbecoming conduct, to include use of profane, obscene and/or abusive or threatening language by Licensee/Vendor, may well be grounds for termination of license agreement and eviction from Festival grounds. As stated previously, this is a family event.
33. The VENDOR hereby agrees to indemnify and hold harmless the SCF, its Agents, Employees and the City of LaBelle from and against all claims, suits, actions and damages and/or causes of action arising during the period of use and occupancy by VENDOR from the date of entry upon the Festival grounds, to and including date of departure, for any personal injury, loss of life, and/or damages or property, including the SCF's property or employees, sustained in and about the premises or that portion of the buildings or appurtenances thereto, used by the Licensee/Vendor, occurring during such time as the VENDOR may be using said premises, and from and against all costs, legal fees, expenses and liabilities incurred in and about any action thereon, and from and against any order, judgment and/or decrees which may be entered therein when any of the aforesaid are caused by negligence of the Licensee/Vendor, its agents, subcontractors, or employees, or persons attending the premises by reason of the use thereof by the Licensee/Vendor. SCF reserves the right to cancel this license If just cause is provided. VENDOR expressly waives any recourse for damages against SCF in the event this agreement is revoked or cancelled by SCF for violation of any of the provisions hereof.
VENDOR AGREES NOT TO NEGATIVELY COMMENT ON SOCIAL MEDIA. VENDOR AGREES NOT TO RECORD OTHER VENDORS OR FESTIVAL OFFICIALS OR AGENTS WHILE ON THE FESTIVAL GROUNDS.
