Artisan and Small Business Vendors

By submitting an application to exhibit at the Braid Mill Night Market, the Vendor (hereinafter referred to as "Applicant") agrees to assume all risks associated with participation in the event, including, but not limited to, injury to persons, damage to property, and loss or theft of goods. The Applicant hereby releases, waives, discharges, and covenants not to sue Braid Mill, its officers, agents, employees, and volunteers (hereinafter referred to as "Event Organizers") from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, or injury that may be sustained by the Applicant or any of the Applicant's property while participating in the event. The Applicant agrees to indemnify, defend, and hold harmless the Event Organizers from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to the Applicant's participation in the event, including but not limited to any injury to persons or damage to property caused by the Applicant, its agents, employees, or representatives. The Applicant agrees to obtain and maintain, at its sole expense, comprehensive general liability insurance with limits of not less than $1,000,000 per occurrence and $2,000,000 aggregate. Such insurance shall name Braid Mill as an additional insured. The Applicant shall provide a Certificate of Insurance evidencing such coverage and naming Braid Mill as an additional insured at least fourteen (14) days prior to the event. Failure to provide the required Certificate of Insurance will result in the forfeiture of the Applicant's participation in the event. By submitting this application, the Applicant acknowledges that they have read, understood, and agree to comply with the terms and conditions outlined in this waiver. The Applicant further acknowledges that they have the authority to enter into this agreement and bind their respective organization or business to its terms.
