GENERAL RULES and REGULATIONS
The rules and regulations set by the City of Kimmswick and the Kimmswick Events Committee are binding for all vendors.
This application is an electronic agreement. By submitting it you affirm you have read these terms and conditions and agree to adhere to them.
No festival vendor spaces will be secured as complimentary by any business or nonprofit organization that engages in the sale of goods, products or services at City of Kimmswick festivals.
No private property space-leased vendors will be permitted to participate in the Kimmswick Strawberry Festival. No temporary business licenses will be issued by the City of Kimmswick to private property space-leased vendors.
No festival vendor spaces may be subleased to or secured on behalf of another organization at City of Kimmswick festivals. No exceptions will be made.
No partial or half vendor spaces will be made available or sold at City of Kimmswick festivals.
No trademark infringement will be permitted. Monitoring and enforcement personnel are on site throughout the festival.
The City of Kimmswick and the City of Kimmswick Events Committee reserve the right to accept or refuse any vendor application, in their sole and absolute discretion.
NO REFUNDS WILL BE ISSUED AFTER MAY 1, 2025.
NO EXCEPTIONS WILL BE MADE.
BY APPLYING TO BE A VENDOR AT THIS EVENT, YOU ACKNOWLEDGE AND CONFIRM YOUR UNDERSTANDING THAT THERE ARE NO REFUNDS AFTER MAY 1, 2025.

The City of Kimmswick and the City of Kimmswick Events Committee reserve the right to accept or refuse any Vendor/Corporate Sponsor application, in their sole and absolute discretion. By participating as a Vendor/Corporate Sponsor at the City of Kimmswick Strawberry Festival, you release and hold harmless the City of Kimmswick and its employees, City officials, and agents, private property owners, the Events Committee and its individual members from all responsibility for damage/loss/theft to the crafts/products/food displayed and/or sold and your personal possessions as well as for any personal injury to yourself or others. You are responsible for any injury that occurs to your booth/tent/vehicle/equipment and display items. You agree to indemnify and hold harmless said organizations and individuals for any damage or injury which may result from the sale/display/operation of your products.
The City of Kimmswick, City officials, employees and agents, private property owners, the Events Committee and its individual members shall be held harmless from and against all expenses, claims, actions, liabilities, attorney fees, damages, and losses of any kind whatsoever resulting from or connected with the operation of any event space rented from the City of Kimmswick.
You hereby release the City of Kimmswick, Missouri, and its employees, officials and agents, private property owners, the Events Committee, and its individual members from responsibility for damage to the arts/crafts/food or products displayed/sold and my personal possessions as well as for any personal injury to myself or others.

By submitting this application, I understand that I am also responsible for any injury that occurs to my booth/tent/event display. I also agree to indemnify and hold harmless said organizations and individuals for any damage or injury which may result from the sale or display of my products.
I hereby release the City of Kimmswick, Missouri, and its employees and agents, private property owners, the Events Committee, and its individual members from responsibility for damage to the arts/crafts/food or products displayed/sold and my personal possessions as well as for any personal injury to myself or others.
Further, I hereby affirm that I am at least 18 years of age and legally competent to enter into contracts under Missouri law, as per Mo. Rev. Stat. § 431.055.

SETUP
Upon arrival as a vendor, please be certain to set up in your assigned space(s). If you do not set up in your assigned space(s) a City/festival official will attempt to reach you to move immediately. If necessary, the contents/products of your booth will be moved to the correct space. The City of Kimmswick and/or City/festival official will not be responsible for any damage done during the transfer/storage of items.

PARKING
Parking on City of Kimmswick streets the Thursday and Friday prior to the festival is prohibited due to festival setup. Cars parked on city streets after booth item drop-off will be towed at the owner's expense. Non-street space-assigned vendors may begin set up on the Thursday and Friday prior to the festival. However, vendors assigned to street spaces may not begin set up until after 4:00 PM on the Friday before the festival.
If you prefer to set up the day of the festival, your vehicle must be moved off city streets before 8:00 AM. You will need to unload your vehicle and move it to a designated parking area as soon as possible.
An additional parking pass per vendor may be picked up at Kimmswick City Hall on a first-come, first-served basis until the lots reach capacity. Parking will also be available at Windsor School Campus and the City of Kimmswick ball field for a nominal fee. Please enter the City of Kimmswick via Montebello Road on the Saturday and Sunday of the festival.
Please do not move your vehicle from designated parking areas prior to 5:00 PM on festival days if at all possible.
