TERMS & CONDITIONS The purpose of this agreement is to outline the terms and conditions under which the Food Vendor is authorized by the Mountain View Area Chamber of Commerce to operate a food concession during the event, in accordance with Ordinance #90-2 from the City Council of Mountain View, Arkansas. HOURS:The concession business hours shall commence on Friday, April 18th, and extend through Saturday, April 19th, 2025. Vendors may set up any time after 5:00 PM on Thursday, April 17th, 2025, but must be fully set up no later than 9:00 AM on Friday, April 18th, 2025. Exceptions to this schedule can only be granted by the Executive Director of the Mountain View Chamber of Commerce. MENU:
Food vendors agree to offer only those food items that have been authorized by the Mountain View Area Chamber of Commerce. Any changes or additions to the menu must receive prior approval from the chamber. Failure to comply with this requirement may result in the removal of unauthorized items. Persistent violation of this policy may lead to the vendor's removal from the event. TERMINATION OF RIGHTS:
The Chamber of Commerce reserves the right to terminate the vendor's operation at any time if the quality of the products does not meet the standards set by the Vendor Committee. Furthermore, the chamber reserves the right to terminate this agreement if the vendor violates health department regulations, fails to cooperate with chamber representatives, breaches any agreement herein, or engages in activities that compromise security. REFUNDS:
There is a strict no-cancellation policy in place for this event. It will proceed rain or shine. COMMISSIONS AND PAYMENT:
In exchange for the privilege of selling consumable food or drinks during Folk Fest, vendors agree to pay the Mountain View Chamber of Commerce a fee of $500.00 for a space up to 20 feet long. Chamber members are eligible for a discounted rate of $400.00. All prices listed for items must include applicable sales tax, and vendors are responsible for collecting and remitting taxes as required by Arkansas law. PREMISES:
Vendors must ensure that the premises are left in the same condition as they were found. This includes maintaining cleanliness around the trailer, disposing of trash properly, and securing items prone to blowing away or spilling. Any large boxes or oil containers must be disposed of in designated dumpsters. Failure to adhere to cleanliness standards may result in denial of future participation. Utilities provided include water and electricity, while hoses and electrical cords are not provided. Ice is also not provided. INDEMNIFICATION:
Vendors must obtain liability insurance to protect against claims for losses, injuries, or property damages during the contract term. By participating in the event, vendors release the Mountain View Area Chamber of Commerce, the City of Mountain View, and the sponsoring organization from any liability for damages sustained by themselves, their staff, volunteers, employees, contractors, or customers. Vendors also agree to indemnify the Chamber, the city, and the sponsoring organization for any losses or liabilities incurred due to injuries or damages suffered by the aforementioned parties.Thank you for your attention to these terms and conditions.
