The purpose of this agreement is to set forth the Terms and Conditions whereby the Food Vendor is authorized by the Mountain View Area Chamber of Commerce to operate a food concession for the purpose of selling food, Ordinance #90-2 from the City Council of Mountain View, Arkansas.
1. TERMS AND CONDITIONS:
HOURS: The concession business hours shall be beginning Saturday, December 2, 2023, and shall continue in operation through Sunday, December 3, 2023. Vendors may set up any time AFTER 5:00 pm Friday, December 1, 2023 but must be set up no later than 9:00 am Saturday morning, December 2nd. Only the Executive Director of the Mountain View Chamber of Commerce has the right to make exceptions.
MENU: The food vendor agrees to include only the food items shared with and authorized by the Mountain View Area Chamber of Commerce. Any changes or additions MUST be cleared with the chamber prior to serving or will be subject to removal. IF YOU HAVE BEEN TOLD TO NOT SELL AN ITEM AND CONTINUE TO DO SO YOU CAN AND WILL BE REMOVED.
TERMINATION OF RIGHTS:
The Chamber of Commerce reserves the right to terminate the operation of the Vendor at any time if the product being sold is not of the highest quality as determined by the Mountain View Area Chamber of Commerce Vendor Committee. The Chamber of Commerce reserves the right to terminate this agreement at any time if Vendor, in the judgment of the Chamber, violates the provisions of the Health Department; fails to cooperate with the representatives of the Chamber; breaches any of the agreements herein; or causes acts breaching security issues.
REFUNDS: We have a no-cancelation policy. This is a rain or shine event.
2. COMMISSIONS AND PAYMENT:
In exchange for the right to sell consumable food or drink during the festival, the Vendor agrees to pay the Mountain View Chamber of Commerce a fee of $500.00 $250.00. If you are a member of the Mountain View Area Chamber of Commerce your fee is $400.00 $200.00. Non-Profit Food Vendors agree to pay a fee of $250.00 $125.00.
Prices on all items sold by the Vendor shall include sales tax. The Vendor shall be responsible for the collection and payment of any tax upon the gross receipts, as required by Arkansas Law.
3. PREMISES:
The Vendor warrants that the premises shall be left in the same condition that they were found. Vendor shall make every attempt to keep the area around the trailer clean. This includes picking up trash, and no dumping of grease, or any refuse in the vending area. Additionally, this includes securing napkins, straws, or other items that have a tendency to blow around or be spilled. Any large boxes or oil containers must be carried and put in dumpsters located on the premises. Please ask if you do not see a dumping station for such large items. If you leave trash you may not be allowed to return.
Potable water and electrical hook-ups shall be provided. You must provide your own hoses and/or electrical cords.
The Chamber of Commerce does not provide ice to vendors. You are responsible for supplying your ice.
4. Indemnification:
The Vendor agrees to obtain liability insurance to protect the vendor against all claims for losses, injury, or property damages during the term of the contract.
The Vendor hereby releases the Mountain View Area Chamber of Commerce, the City of Mountain View, and the sponsoring organization from any liability for any damages sustained by the vendor, volunteer’s employees, contractors or customers. The vendor agrees to indemnify the Mountain View Area Chamber of Commerce, the City of Mountain View, and the sponsoring organization for any loss or liability, including the cost of defending any claim or lawsuit the Mountain View Area Chamber of Commerce, the City of Mountain View and the sponsoring organization may suffer as a result of any injuries or damages suffered by the vendor's staff, volunteers, employees, contractors or customers.
