Organization hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE THE CITY, ITS OFFICERS, SERVANTS, AGENTS, EMPLOYEES, CONTRACTORS AND INSURERS, INCLUDING BUT NOT LIMITED TO THE TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL (HEREINAFTER REFERRED TO COLLECTIVELY AS “RELEASEES”) FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS AND CAUSES OF ACTION WHATSOEVER ARISING OUT OF OR RELATING TO ANY LOSS, DAMAGE OR INJURY, INCLUDING DEATH, THAT MAY BE SUSTAINED BY ORGANIZATION OR THE PARTICIPANTS IN ORGANIZATION’S EVENT, OR TO ANY PROPERTY BELONGING TO ORGANIZATION OR ANY EVENT PARTICIPANT, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES, OR OTHERWISE, WHILE PARTICIPATING IN EVENT ACTIVITIES, OR WHILE IN, ON OR UPON ANY CITY FACILITIES OR SITES WHERE THE EVENT ACTIVITIES ARE BEING CONDUCTED, WHILE IN TRANSIT TO OR FROM THE CITY FACILITIES OR SITES, OR IN ANY PLACE OR PLACES CONNECTED WITH EVENT ACTIVITIES. ORGANIZATION FURTHER HEREBY AGREES TO INDEMNIFY, HOLD HARMLESS AND DEFEND THE RELEASEES AND EACH OF THEM, FROM ANY LOSS, LIABILITY, DAMAGE OR COSTS THEY MAY INCUR DUE TO ORGANIZATION EVENT ACTIVITIES OR FROM ANY PARTICIPANT’S PARTICIPATION IN EVENT ACTIVITIES, WHETHER CAUSED BY THE NEGLIGENCE OF ANY OR ALL OF THE RELEASEES, OR OTHERWISE.
