HauntFest Code of Conduct Waiver, Release, and Hold Harmless Agreement In consideration of my participation in this HauntFest, LLC festival (the "Activity"). I (together with family, spouse, heirs, representatives and assigns) represent, covenant and agree, on behalf of myself and my heirs, assigns, and any other person claiming by, under or through me, as follows: I, a patron/participant in HauntFest, LLC, acknowledge the potential risks to attending a haunted festival, including but not limited to risk of heart attack, injury to person, lost or stolen property, seizure, and any other form of unintentional harm that may be a result of uneven grounds, jump scares, loud music, or flashing lights. I acknowledge that participating in the Activity involves certain risks (some of which I may not fully appreciate) and that injuries, death, property damage or other harm could occur to me or others. I accept and voluntarily incur all risks of any injuries, damages, or harm which arise during or result from my participation in the Activity, including any associated activities, regardless of whether or not caused in whole or in part by the negligence or other fault of the HauntFest, LLC, the venue, and/or its or their departments, trustees, affiliates, employees, officers, agents or insurers ("Released Parties"). Under Georgia Law, there is no liability for unjust or death of an individual entering these premises if such injury or death results from the inherent risk of contracting Covid-19. I am assuming this risk by entering these premises. I waive all claims against any of the Released Parties for any injuries, damages, losses or claims, whether known and unknown, which arise during or result from my participation in the Activity, regardless of whether or not caused in whole or part by the negligence or other fault of any of the Released Parties. I release and forever discharge the Released Parties from all such claims. I understand that audio and video recordings and photographs may take place during any or all event nights for the sole purpose of advertisement and film-making purposes to which I will not receive any monetary compensation. I acknowledge that I may be expelled from the event without refund if I cause any threat to the safety or integrity of the festival, its participants, or its staff. Disrespect will not be tolerated. By purchasing event tickets or applying for the event, I agree to the guidelines contained herein with regard to HauntFest, LLC and the event venue. I also agree to Hold Harmless HauntFest, LLC and the event venue, their staff, their affiliates, tenants, and committee members thereof, from any claim including limited injury to person, damage to property, loss by fire, theft, or any other cause, nor will I/we be a party to any lawsuit. This is a legal and binding Hold Harmless Agreement. I agree to indemnify and hold the Released Parties harmless from all losses, liabilities, damages, costs or expenses (including but not limited to reasonable attorneys' fees and other litigation costs and expenses) incurred by any of the Released Parties as a result of any claims or suits that I (or anyone claiming by, under or through me) may bring against any of the Released Parties to recover any losses, liabilities, costs, damages, or expenses which arise during or result from my participation in the Activity, regardless of whether or not caused in whole or part by the negligence or other fault of any of the Released Parties. BASICALLY: I am voluntarily participating in this event at my own risk. I understand there may be videos/photos taken at the event for event media. I will not cause any threat to the safety or integrity of the festival. I will be respectful. I have carefully read and reviewed this Waiver, Release And Hold Harmless Agreement. I understand it fully and I execute it voluntarily.
