1. Eligibility - By signing up to perform at Newnan Porchfest ("Festival"), you ("Musician") confirm that you have the legal right to perform the music you intend to showcase at the Festival. Musicians of all ages are welcome to apply. For Musicians under the age of 18, parental or legal guardian consent is required.
2. Submission of Materials - As part of the sign-up process, Musicians may be required to submit promotional materials, including but not limited to audio recordings, videos, photos, and biographical information. By submitting these materials, the Musician grants the Festival a non-exclusive, royalty-free license to use the materials for promotional purposes related to the Festival.
3. Performance Selection - Submission of an application does not guarantee selection to perform at the Festival. The Festival organizers will review all applications and select performers at their sole discretion. Musicians will be notified of their selection status by March 1st.
4. Performance Commitment - By accepting an offer to perform at the Festival, the Musician agrees to commit to the scheduled performance time(s) and location(s) as determined by the Festival organizers. Changes to the schedule will only be made by the Festival and communicated to the Musician as necessary.
5. Compensation - The terms of compensation, if any, will be outlined in a separate agreement between the Festival and the Musician. Unless explicitly stated, no financial compensation will be provided for performances at the Festival. Musicians are allowed to sell merchandise or collect tips, subject to Festival policies.
6. Equipment and Setup - The Festival will provide basic sound equipment and technical support as specified in the Musician Information Packet. Musicians are responsible for bringing their own instruments and any additional equipment required for their performance. The Festival is not liable for any damage or loss of equipment brought by the Musician.
7. Code of Conduct - Musicians are expected to conduct themselves professionally and respectfully towards Festival staff, volunteers, other performers, and attendees. Any behavior deemed inappropriate by the Festival may result in the immediate termination of the Musician's performance and removal from the Festival premises.
8. Liability - The Festival will take reasonable precautions to ensure the safety of all performers and attendees. However, the Musician agrees to perform at their own risk and waives any claims against the Festival, its organizers, sponsors, or affiliates for any injury, loss, or damage incurred during their participation.
9. Cancellation- The Festival reserves the right to cancel or reschedule performances at any time due to unforeseen circumstances, including but not limited to weather conditions, safety concerns, or other factors beyond the Festival's control. In such cases, the Festival will make reasonable efforts to notify Musicians as soon as possible, but no compensation will be provided for cancellations.
10. Media Release - By participating in the Festival, the Musician consents to the recording, photographing, and filming of their performance. The Musician grants the Festival and its affiliates the right to use such recordings and images in promotional materials, media broadcasts, and social media without further compensation.
11. Intellectual Property - The Musician retains all rights to their original music and compositions performed at the Festival. However, the Musician grants the Festival a non-exclusive license to use excerpts of their performance for promotional purposes.
12. Governing Law - These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of laws principles.
13. Acceptance of Terms - By submitting an application to perform at the Festival, the Musician acknowledges that they have read, understood, and agree to these Terms and Conditions.
