Apple Butter Makin’ Days Parade Accident Waiver and Release of Liability Form

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING AND/OR VOLUNTEERING IN THIS ACTIVITY OR EVENT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.
I certify that I am physically fit, have sufficiently prepared or trained for participation in the activity or event, and have not been advised to not participate by a qualified medical professional. I have no health-related reasons or problems that would preclude my participation in this activity or event.
I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity or event in which I participate and that it will govern my actions and responsibilities at said activity or event. In consideration of my application this permits me to participate in this event, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
A. I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this event, THE FOLLOWING ENTITIES OR PERSONS: Mt. Vernon Chamber of Commerce, Apple Butter Makin’ Days Committee, City of Mt. Vernon, County of Lawrence, their directors, officers, employees, members, volunteers, representatives, and agents, the activity or event holders, activity or event sponsors, activity or event volunteers;
B. I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity or event, whether caused by the negligence of release or otherwise.
I acknowledge that the Mt. Vernon Chamber of Commerce, Apple Butter Makin’ Days Committee, and their directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific event or activity on behalf of the Mt. Vernon Chamber of Commerce.
I acknowledge that this activity or event may involve a test of a person’s physical and mental limits and may carry with it the potential for death, serious injury, and property loss. The risks may include but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, and actions of other people including, but not limited to, participants, volunteers, spectators, coaches, event officials, and event monitors, and/or producers of the event, and lack of hydration. These risks are not only inherent to participants but are also present in volunteers.
I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity or event. I understand that I may be photographed at this event or related activities. I agree to allow my photo, video, or film likeness to be used by the event holders, producers, sponsors, organizers and assigns for any legitimate purpose. The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
I hereby assume all liability associated with distributing items to participants and/or spectators of the Apple Butter Makin’ Days Parade, including but not limited to any risks that may arise from negligence or carelessness on the part of individuals associated with my parade entry. I agree to abide by all the rules and regulations of the event and swear that all items will be handed to spectators by participants walking alongside our entry, will never be thrown to any spectator by any participant with our entry, and will not delay the progression of our entry or any entry after us. I hereby agree to the following regulations associated with participation in the Apple Butter Makin’ Days Parade and how our interaction with spectators of the Apple Butter Makin’ Days Parade will occur, including but not limited to any risks that may arise from negligence or carelessness on the part of individuals associated with my parade entry.
2023 APPLE BUTTER MAKIN’ DAYS PARADE REGULATIONS
Failure to comply with all rules and regulations may impact future participation in the Apple Butter Makin’ Days Parade.
1. Items may be thrown from parade entries at any point in the parade. Please throw far enough away from your vehicle so children are not running into the street to retrieve items. Please GENTLY toss items.
2. Floats must be decorated to be eligible for judging. A vehicle with the company’s name or logo on it is NOT considered a decorated "float". Easy-to-use float “kits” can be used for ideas or your entire entry. Many online sources can be found through a simple Google search, including www.victorycorps.com, www.shindigz.com, www.fbsind.com, www.spiritline.com, www.stumpsparty.com.and
3. Entries with children under the age of 18 must also have parents or other adult chaperones. Participants are asked to be aware of the ability and pace of ALL persons in their group and to make alternative arrangements for any person slowing the progress of the parade entry.
4. All entries must with music or sound amplifying systems shall maintain a volume that will not interfere with other entries. Each entry is responsible for acquiring all copyright permissions for any music played by their participants.
5. All motorized entries must be properly maintained, have a full tank of gas, good working brakes, and a properly installed air filter and muffler. NO excessively loud motorized vehicles or machinery will be allowed. The vehicle must be driven by a licensed driver over 16 years of age and have unobstructed visibility, NO EXCEPTIONS.
6. Individuals and organizations participating in the parade are expected to perform courteously, in good taste, and with safety in mind at all times during the assembly, execution, and dispersal of the parade. All entries are required to keep moving and not delay the progression of the parade. Entries causing delays or gaps in the progression of the parade may be asked to speed up their pace to remedy the problem, and those causing continued issues may not be permitted to return the following year. If you are approached for a media interview or photographs, please step out of the parade flow, allow others to pass you, and catch up to your entry when your interview is finished.
7. There will be NO countermarching, maneuvering, or any other action, or inaction, in any form, that will create any gap in the progress of the parade. All maneuvering, choreography, and marching styles must be performed while moving forward. Keep in visual contact with entries in front of and behind you at all times and adjust your speed accordingly. Be prepared to follow ALL instructions given by parade officials BEFORE AND DURING the parade.
8. Distributing any type of fireworks, including confetti "poppers" and bang snaps/“snappers”, to the audience is prohibited, and any entry doing so will be held liable for any damage reportedly caused by those items.
9. Parade entries involving animals must provide immediate clean-up in the line-up area and along the parade route.
10. Please refrain from using any trademarked items in print or decorations on floats.
AT ANY TIME any entry or persons not complying to the rules and regulations, or refusing to follow these instructions of the police or parade officials will result in the removal from the parade. The Mt. Vernon Chamber of Commerce reserves the right of final decision on entries accepted for the parade.
